These terms and conditions apply to purchases of goods from the Agroparts.ee online shop. By placing an order you confirm that you have read and accept these terms.

We have the right to amend the terms. Amendments are published on this page. An order is governed by the terms that were in force at the time the order was placed.

2. Definitions

A Consumer is a natural person who buys goods outside their economic or professional activity. The Consumer has all the rights arising from the Consumer Protection Act and the Law of Obligations Act, including the 14-day right of withdrawal.

A Buyer is a legal person or a sole proprietor who buys goods in the course of their economic or professional activity. The Buyer does not have the statutory 14-day right of withdrawal; returns are by agreement, see section 9.

The Webshop is the online shop at Agroparts.ee.

3. Prices

All prices are in euros. The transaction currency is the euro.

By default, prices are shown including 24% VAT. In the page header you can switch prices to be shown excluding VAT. The order confirmation and the invoice always show the amount excluding VAT, the VAT and the total.

To a company from another European Union member state with a valid VAT number, we sell under the reverse charge, without VAT.

The delivery cost for the selected delivery method is added to the price of the products. You will see the delivery cost before you confirm the order.

Prices in the online shop may differ from prices in the Rakvere shop.

We have the right to change prices. If an order was placed before a price change, the price in force when the order was placed applies.

4. Placing an order and conclusion of the contract

  1. Add the products you want to the shopping cart.
  2. In the cart, choose "Check out" ("Vormista tellimus").
  3. Fill in your contact and delivery details and choose a delivery method.
  4. Choose a payment method and confirm the order.

Please fill in the details carefully. Fast and smooth processing of your order depends on the accuracy of the details you provide.

After you place the order, we will send an order confirmation to your email address. The sales contract is deemed concluded once we have confirmed the order and the payment has been received.

Orders are processed on working days Mon-Fri 8.00-17.00. Orders placed on Friday after 14.00 are processed on the following Monday. The same applies to collection in person.

If the order has not been paid for within 5 working days of being placed, we have the right to cancel it.

If the ordered goods cannot be delivered, we will contact you and offer a substitute product or cancel the order. If the order is cancelled, we will refund the full amount paid.

5. Payment methods

You can pay in the Webshop by the following methods:

ESTO Pay bank links and ESTO hire purchase are available only for orders delivered in Estonia.

Card payments take place in the payment service provider's secure environment. We do not see or store your card details at any point. Data transmission between your device, the Webshop and the payment service provider is encrypted (TLS).

The payment service provider sends us only information on whether the payment succeeded or failed.

6. Delivery

The delivery area is Estonia, Finland, Latvia and Lithuania. To arrange delivery to other countries, contact us before placing the order at info@agroparts.ee.

Delivery methods:

The delivery cost depends on the selected delivery method, the weight of the shipment and the order amount. You will see the exact delivery cost before you confirm the order.

Goods in stock usually arrive in Estonia within 1-2 working days of receipt of payment, and in Finland, Latvia and Lithuania a few working days later.

If the ordered quantity exceeds the quantity currently in stock, it is still one order. The order is paid for in full when it is placed. The order is delivered as one shipment once the missing products have arrived in our warehouse. Delivery in several parts is by agreement between the parties.

When an order is delivered in parts, the delivery cost is charged once and no additional delivery cost is added for sending the follow-up delivery.

If no delivery time has been separately agreed for the order, the statutory time limit of up to 30 days applies.

If the goods cannot be delivered, we will refund the amount paid for them.

We hand the shipment over to the carrier at the first opportunity after receipt of payment. If delivery of the shipment is delayed, or the shipment is damaged or lost in transit, contact us. We will clarify the situation together with the carrier and propose a suitable solution. This does not limit the Consumer's statutory rights.

Where possible, please note any visible transport damage on the carrier's document and notify us as soon as possible, preferably within 3 working days. Later notification does not limit the Consumer's statutory rights.

7. Suitability of the product

In the case of spare parts, the suitability of the product for a specific machine is the Buyer's responsibility.

The original numbers (OE numbers), cross-references and lists of machine models given in product descriptions are for reference. They help you find a part but are not the manufacturer's confirmation of suitability. Different series and years of manufacture of the same model may use different parts.

If you are not sure about suitability, contact us before placing the order: +372 526 0545 or info@agroparts.ee. We give advice on suitability free of charge.

Ordering the wrong part is not a defect of the product. In that case, the right of withdrawal described in section 8 applies to the Consumer and the agreed return described in section 9 applies to the Buyer.

8. Consumer's right of withdrawal

The Consumer has the right to withdraw from a contract concluded in the online shop without giving a reason within 14 days.

The period begins on the day on which the Consumer, or a third party designated by the Consumer, receives the goods. If the order arrives in several shipments, the period begins when the last shipment is received.

8.1. How to withdraw

Use the withdrawal form on the "Return a product" page. Filling in the form takes a minute and you do not need to log in.

If you prefer, you can also give notice of withdrawal by email to info@agroparts.ee or by letter to Agroproff OÜ, Rägavere tee 38, 44312 Rakvere.

We will confirm receipt of the withdrawal notice by email without delay. The confirmation contains the content of the notice and the date and time it was sent.

8.2. Returning the goods

Return the goods within 14 days of submitting the withdrawal notice to Agroproff OÜ, Rägavere tee 38, 44312 Rakvere.

The direct costs of returning the goods are borne by the Consumer.

Some of the spare parts we sell are large or heavy and cannot be returned through a parcel locker. The return cost of such goods depends on the weight and dimensions of the shipment and is higher than usual. We will tell you the approximate cost before the return if you contact us.

The returned goods must be complete. Please use the original packaging or equivalent protection so that the goods are not damaged in transit.

8.3. Refund

We will refund all payments received from you, including the cost of delivering the goods, no later than 14 days after receiving the withdrawal notice.

We refund the delivery cost up to the amount of the cheapest delivery method we offer. If you chose a more expensive delivery method, the difference is not refunded.

We refund the money using the same payment method you paid with, unless otherwise agreed. We do not charge a fee for the refund.

We have the right to delay the refund until we have received the goods back or until you have submitted proof that you have sent the goods back, whichever occurs first.

8.4. Diminished value of the goods

The Consumer is liable for a diminished value of the goods only if the goods have been used in a way other than is necessary to establish their nature, characteristics and functioning. The goods must be handled as they could be in a shop.

The value of a spare part that has been installed and put into use has usually diminished. If you are unsure about suitability, check it before installing.

8.5. When there is no right of withdrawal

The right of withdrawal does not apply to goods that are made or ordered to the Consumer's personal requirements as a special order.

9. Returns by business customers

A Buyer who buys goods in the course of their economic or professional activity does not have the statutory 14-day right of withdrawal.

We take back wrong or unneeded goods by agreement. Contact us at info@agroparts.ee. A return requires that the goods are unused, complete and in the original packaging and that no more than 30 days have passed since the purchase. The return cost is borne by the Buyer.

Goods brought in as a special order are not taken back.

This section does not limit the Buyer's rights if the goods do not conform to the contract, see section 10.

10. Non-conformity and submitting complaints

We are liable to the Consumer for any non-conformity of the goods sold with the terms of the contract that becomes apparent within two years of delivery of the goods.

The Consumer must notify us of the defect within two months of discovering it.

If a defect appears, stop using the goods and contact us.

To submit a complaint, write to info@agroparts.ee and include:

We will respond to the complaint as soon as possible and no later than 14 days after receiving it.

We will agree with you on the repair or replacement of the defective goods. We cover the costs of repair.

If repair or replacement of the goods is not possible or fails, the Consumer has the right to demand a reduction of the purchase price or to withdraw from the contract and receive a refund.

We are not liable for defects that have arisen as a result of improper storage, installation or use of the goods for a purpose other than intended, or for natural wear and tear.

No separate commercial guarantee is given for the goods unless stated otherwise on the product. This does not limit statutory rights.

11. Liability and force majeure

We are liable to you to the extent provided by these terms and the legislation of the Republic of Estonia.

We are not liable for damage caused by circumstances that we could not influence or foresee, including the actions of the carrier, a natural disaster or an interruption of communication and information systems.

We are not liable for indirect damage or loss of profit.

12. Processing of personal data

We process your personal data to fulfil the order and to comply with obligations arising from law. For more information, see the privacy policy.

To fulfil the order, we pass the necessary data to the following partners:

We send direct marketing emails only with your prior consent, and you can withdraw your consent at any time.

13. Dispute resolution

We try to resolve all disagreements through negotiation. Write to info@agroparts.ee or call +372 526 0545.

If no agreement is reached, the Consumer has the right to turn to the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (Endla 10a, 10142 Tallinn, info@ttja.ee, www.ttja.ee). Turning to the committee is free of charge for the Consumer.

A Consumer who has bought from another European Union member state can get advice from the European Consumer Centre.

The Consumer also has the right to go to court.

The contract is governed by the law of the Republic of Estonia.

14. Language

This is a translation of the Estonian terms and conditions. In case of any discrepancy, the Estonian version prevails.
